This Notice is provided by Attorneys Fabio Ambrosio and Marco Maccaferri (hereinafter, also “Professionals”) pursuant to Art. 13 of EU Regulation 2016/679 (General Data Protection Regulation; hereinafter, “GDPR”) and concerns the processing of personal data of the data subject carried out by Professionals in the exercise of their professional activities, including through the website www.studiolegaleamp.com (hereinafter, “Site”).

1. Data controller

The Data Controller is Lawyer. Fabio Ambrosio (C.F. MBRFBA82R25H931D – P.IVA 0708989081215), with office and professional domicile in Milan (20122) at Via Lamarmora no. 33 (e-mail: ambrosio@studiolegaleamp.com, tel. 02.23172227, fax. 02.23172237).

2. Purpose

Personal data are collected and processed, both manually and through electronic systems, by the Data Controller and assigned personnel for the following purposes: execution of the contract, pre-contractual measures and/or requests of the interested party; All in full compliance with the security and confidentiality regulations provided for in the current provisions.

3. Legal basis

The legal basis for processing, depending on the case, is at least one of the following: performance of a contract with the data subject and/or pre-contractual measures; pursuit of a legitimate interest of the data controller or a third party, provided that interests and rights do not prevail; fulfillment of legal and regulatory obligations or any orders of the Authorities; exercise and/or defense of a right in the competent courts.

4. Provision of data.

Interested parties can also contact the Professionals using the online form provided and/or by emailing them directly. In this case, the data subject voluntarily gives his/her data to the Data Controller, including his/her email address, in order to submit questions and/or be contacted.

The provision of personal data in connection with the execution of the contractual relationship and/or the requests of the interested party is mandatory; any refusal will result in the inability to fulfill the requested services.

5. Method of treatment

Personal data are processed by automated and non-automated means for the time strictly necessary to achieve the purposes for which they were collected. Personal data are not transferred to third parties. No data is released.

Data processing takes place at the office of the Data Controllers, 33 Lamarmora Street, Milan. Emails received by the User are also stored hosted on Server Plan Srl Servers, in Italy. Professionals may use cloud services from well-known providers (e.g., Google, Dropbox, Onedrive) that involve a transfer of data to the U.S., authorized by the European Commission’s adequacy assessment and the safeguards provided by the so-called Privacy Shield.

The data stored on paper media are kept in special registers and/or cards, the preservation of which is implemented with storage in special containers, kept at the premises of the Holders. Adequate security measures are taken against the risk of intrusion and unauthorized access, suitable for ensuring the integrity, availability and confidentiality of data, as well as the protection of areas and premises relevant to their safekeeping and accessibility.

Personal data may be disclosed to parties (so-called “recipients”) for the purposes determined by the legal basis applicable from time to time.

Data are processed with logic related to the above purpose, so as to ensure the security and confidentiality of the data.

Data are kept at the premises of the Data Controllers for a period of time not exceeding that necessary for the purposes for which they were collected and subsequently processed. Specifically:

The data subject may exercise against the Data Controllers the rights provided for in Articles 15-22 of the GDPR, as applicable. For legitimate reasons, the data subject may object, in whole or in part, to the processing of personal data (Art. 21 GDPR), by sending the Holders the relevant application by regular mail, e-mail or fax. In particular, the data subject has the right at any time to object to the sending of commercial communications.

Pursuant to Article 77 of the GDPR, the data subject also has the right to lodge a complaint with the Supervisory Authority of the Member State where he or she normally resides, works, or where the alleged violation occurred. In Italy, the Garante per la protezione dei dati personali, based in Rome (www.garanteprivacy.it), has jurisdiction.

9. Data collected automatically through the website. Cookies.

Data Controllers are committed to protecting the privacy of visitors and users.

The computer systems and procedures used to operate the Site acquire, in the course of their normal operation, certain data whose transmission is implicit in the use of Internet communication protocols.

This category of data includes IP addresses or domain names of the computers used by users connecting to the site, the URI (Uniform Resource Identifier) notation addresses of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters related to the operating system and the computer environment of the Data Subject.

This data is used for the sole purpose of obtaining anonymous information about the use of the Site, as well as to monitor its proper functioning. The data could be used to ascertain liability in case of the commission of crimes.
